These Terms of Service govern your use of our website and your purchase of goods from Bathroom Sales Direct.

By accessing our website, requesting a quote, placing an order, or purchasing goods from us, you agree to these Terms of Service. Nothing in these Terms excludes or limits any rights you may have under the Australian Consumer Law where those rights cannot be excluded.

Supplier Batch Changes

Products may vary slightly between batches, including finish, tone, fittings, packaging, branding, and specifications.

Check Within 24 Hours

All goods must be inspected within 24 hours of delivery and before installation or disposal of packaging.

Returns Need Approval

Change of mind returns must be approved first and may attract restocking, freight, and admin charges.

Your ACL Rights Remain

If goods have a major failure under ACL, you may be entitled to a refund or replacement.

1. General

These Terms apply to all website users, customers, and purchasers of goods from Bathroom Sales Direct unless otherwise agreed by us in writing.

We may update these Terms from time to time by publishing the updated version on our website. The Terms in effect at the time your order is placed will apply to that order unless otherwise required by law.

2. Orders and Acceptance

All orders placed with Bathroom Sales Direct are offers to purchase only and are subject to acceptance by us.

We may accept, reject, or cancel any order before dispatch, including where there is:

  • a pricing, listing, freight, or description error
  • a stock availability issue
  • a payment issue
  • suspected fraud or unauthorised activity
  • promotion misuse or coupon misuse
  • a technical, migration, system, or integration error
An order confirmation email does not mean final acceptance. Acceptance occurs when goods are dispatched.
3. Product Information, Images, Batch Variations and Supplier Changes

Bathroom Sales Direct sources products from third party suppliers and manufacturers. Suppliers may change or update products from time to time without notice, including dimensions, finishes, colour tone, components, fittings, accessories, packaging, branding, product codes, inclusions, or specification sheets.

While we make reasonable efforts to ensure product descriptions, images, finishes, specifications, dimensions, and other details are accurate at the time of publication, some information is based on supplier material and may not always reflect the latest manufacturing batch or supplier update.

Product images are illustrative only. Actual items received may differ slightly from website images, specification sheets, or previous supplier batches.

By purchasing from us, you acknowledge and agree that:

  • product images, lifestyle images, and finish colours are indicative only
  • screen settings, lighting, photography, and supplier imagery may affect how colours and finishes appear
  • minor variations may occur between production batches
  • suppliers may change specifications, dimensions, accessories, inclusions, or packaging without prior notice to us
  • we may supply the current supplier version of a product available at the time of dispatch
Minor differences that do not materially affect the normal function, intended use, or overall nature of the goods will not be considered a defect, fault, or misdescription and will not entitle a customer to a refund, return, exchange, or compensation for change of mind.

If a variation materially affects the function or essential characteristics of the product, you must contact us in writing as soon as possible and before installation or use.

4. Pricing, Quotes and Listing Errors

We take care to ensure product pricing, freight, and website content are accurate, however errors may occur.

If a product is listed with an incorrect price, freight amount, or description due to a typographical error, supplier error, technical issue, system issue, migration issue, or human error, we reserve the right to cancel the order, request payment of the correct amount, or amend the order before dispatch.

Quotes are indicative only unless expressly confirmed in writing and remain subject to stock availability, freight review, and supplier pricing changes.

5. Sale Events, Promotions and Coupons

Sale periods and promotional events may involve extended dispatch timeframes, fluctuating stock availability, temporary backlogs, and longer response times.

  • only 1 coupon or promotion may be used per order unless expressly stated otherwise
  • coupon stacking is not permitted
  • promotions cannot be combined with trade pricing, negotiated pricing, some clearance lines, or certain other offers unless expressly stated
  • promotions must be applied at checkout and cannot usually be added after an order is placed
  • we may vary, suspend, or end a promotion at any time
During sale periods, dispatch and response times may be longer than usual.
6. Payment

Orders must be paid in full before dispatch unless otherwise agreed by us in writing.

We reserve the right to delay or withhold dispatch where payment is pending, under review, reversed, disputed, or suspected to be unauthorised.

7. Dispatch, Delivery and Freight

Dispatch and delivery timeframes are estimates only unless expressly confirmed by us in writing.

Bulky freight deliveries are generally kerbside only unless otherwise agreed in writing. Customers must ensure there is safe and reasonable access to the delivery address.

Additional freight or re delivery charges may apply where:

  • the delivery address is remote or outside standard service zones
  • there is failed delivery or re delivery is required
  • special access equipment or manual handling is needed
  • the original freight amount was incorrectly calculated
  • the delivery address is changed after the order is placed
We are not responsible for delays caused by third party carriers, supplier delays, depot congestion, weather, public holidays, customs, industrial action, or events outside our reasonable control.
8. Risk, Inspection and Transit Claims

Risk in the goods passes to the customer upon delivery to the nominated delivery address, or upon collection if the goods are collected.

You must inspect all goods carefully within 24 hours of delivery and before installation, use, or disposal of packaging.

For any transit damage, shortage, incorrect item, or apparent delivery issue, you must:

  • notify us in writing within 24 hours of delivery
  • provide clear photographs of the packaging, labels, and affected goods
  • retain all original packaging until the matter is resolved
  • not install, use, alter, or dispose of the goods
Failure to report transit issues within 24 hours may affect our ability to lodge a carrier claim and may limit the assistance we can provide.

Installation or use of goods after delivery is taken as acceptance that the goods were received in acceptable condition, except to the extent your rights cannot be excluded under the Australian Consumer Law.

9. Title and Ownership

Title in the goods does not pass to the customer until all amounts owing in respect of those goods have been paid in full and cleared.

If payment is dishonoured, reversed, charged back, or later found to be unauthorised, we reserve the right to recover the goods and pursue any outstanding amount, subject to applicable law.

10. Pre Orders and Backorders

Some products may be sold as pre order, backorder, or supplier order items. Any estimated arrival or dispatch dates are supplier estimates only and may change without notice.

We are not liable for supplier manufacturing delays, shipping delays, customs delays, or other supply chain disruptions outside our reasonable control.

11. Special Order, Non Stock and Custom Products

Products that are special order, custom made, made to order, supplier ordered specifically for the customer, or not ordinarily stocked by us may not be cancelled, returned, exchanged, or refunded for change of mind once the order has been confirmed with the supplier.

Special finish, custom size, supplier indent, non stock, and custom configuration orders are generally non cancellable and non returnable unless required by law.
12. Change of Mind Returns

We may, in our discretion, approve a change of mind return request. We are not required to accept a change of mind return where the goods are not faulty and do not fail a consumer guarantee.

Any approved change of mind return is subject to all of the following:

  • the request must be made in writing and approved by us before return
  • the goods must be unused, uninstalled, undamaged, and in resaleable condition
  • the goods must be returned in original packaging with all accessories, parts, manuals, and protective materials
  • no writing, labels, stickers, or tape may be applied directly to original product packaging
  • proof of purchase must be provided
Approved change of mind returns may incur a restocking fee of up to 25%, or a higher amount where this reflects the actual supplier fee charged to us, plus outbound freight, return freight, and reasonable admin or handling charges.

Freight charges are non refundable once goods have been dispatched.

For hygiene, safety, or resale reasons, we may refuse returns on certain items including toilet seats, bidet seats, sanitary items, opened consumables, clearance items, spare parts, custom items, and special order products unless required by law.

13. Order Cancellations

If you request a cancellation before dispatch, we may approve the cancellation in our discretion.

If the order has already been processed, packed, booked with a carrier, specially ordered, or committed with a supplier, we may deduct any reasonable costs incurred including supplier cancellation fees, restocking fees, admin charges, and freight charges.

14. Faulty Goods, Defects and Warranty Claims

If you believe goods are faulty, damaged, or do not comply with a consumer guarantee, you must notify us as soon as possible and provide details, photographs, and any other information reasonably requested to assess the claim.

We may require the goods to be inspected, returned, tested, or reviewed by the supplier or manufacturer before a remedy is determined where permitted by law.

Goods must not be installed if a fault, damage, or incorrect item is apparent on inspection. We are not responsible for installation costs associated with goods that were visibly damaged or visibly incorrect before installation.

Manufacturer warranties are separate to, and in addition to, your rights under the Australian Consumer Law.

15. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you may have under the Australian Consumer Law or any other law where such rights cannot lawfully be excluded, restricted, or modified.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Where a product fails to meet a consumer guarantee and the failure is not a major failure, we may choose to repair or replace the goods within a reasonable time, or provide another remedy permitted by law.

Where a product has a major failure, the customer may be entitled to choose a refund or replacement in accordance with the Australian Consumer Law.

16. Limitation of Liability

To the maximum extent permitted by law, we exclude liability for indirect, incidental, special, or consequential loss including delay losses, loss of profit, loss of opportunity, or project delay, except where such liability cannot lawfully be excluded.

We are not liable for plumber, builder, electrician, tiler, or installer costs unless required by law including under the Australian Consumer Law.

17. Customer Responsibilities
  • check product suitability, dimensions, finish, and specifications before purchase
  • ensure the delivery address is correct and accessible
  • use licensed and qualified trades where required
  • not book trades until goods are received and inspected
  • not install goods that appear damaged, faulty, or incorrect
  • check all contents before disposing of packaging
18. Chargebacks and Payment Disputes

If a chargeback or payment dispute is initiated in relation to goods that have been dispatched, delivered, collected, or specially ordered, we reserve the right to provide relevant order records, tracking, proof of delivery, and communications to the payment provider or financial institution.

19. Privacy, Website Use and Intellectual Property

Your use of our website and any purchase from us is also subject to our Privacy Policy.

All website content including text, graphics, logos, product descriptions, images, and layouts is owned by or licensed to Bathroom Sales Direct and must not be reproduced or used without prior written consent except as permitted by law.

20. Force Majeure

We are not liable for any delay or failure to perform our obligations where the delay or failure is caused by an event outside our reasonable control including supplier interruption, freight disruption, natural disaster, fire, flood, pandemic, cyber incident, industrial action, power failure, government action, or carrier delay.

21. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any dispute arising in connection with these Terms or the supply of goods by us is subject to the non exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
